1. General terms
Do not copy, heavily reference, or trace Calnite's art and designs.
Calnite's work may not be used on AI or NFT.
The Client must provide clear and accurate references, instructions, and requirements before work begins.
Calnite only accept Pinterest boards or Google Doc Ref if you are commissioning a character design.Calnite is not responsible for issues caused by unclear or incomplete instructions and reference images provided.
I value open communication and encourage you to reach out with any questions or concerns. No inquiry will be considered inappropriate or excessive.
If I ever reference or remind you of my terms, please know it's simply meant to ensure clarity for both of us, not to suggest issue on your part. I recognize these Terms are detailed, and it's completely normal to forget some parts of it.
If you message me, please give me 2-3 business days to reply. Taking commission is not my full time job, which affect response times. If you haven't heard from me after that, feel free to message me again via an alternative method of contact.
2. Prices
All prices are listed in Swiss Francs (CHF) unless stated otherwise.
Listed prices for illustration commissions are base prices for one simple character that already has a design reference and for non-commercial use only. Prices are subject to change at any time without prior notice.

Commercial usage

Number of characters/elements
Revisions requested
Characters without a proper reference (mood board/doc of random images with description) will be considered custom and may cost CHF 50-200 additionally.
3. Payment
Payments can be made through: Stripe (Invoice send by e-mail, paid with cards) and Wise (Bank transfer). Paypal can be used as last resort.
Payment plans are available for commission over CHF 200.
Payment plans can be 1/2 (paying 50% upfront and 50% after a sketch is approved) to 1/8 custom plans.
The payment can be made after each commission stage, weekly, bi-weekly or, for cases like Vtuber model, monthly.
Delayed payments may result in Delayed Delivery or Cancellation of the commission.
4. Commercial usage
Commercial Usage and NDA terms must be discussed with Calnite beforehand to calculate the price.
A commercial use license grants Client the right to use the work for commercial purposes. This license does not transfer ownership or the rights of the work to Client, nor does it permit Client to reproduce, distribute, or post the work without providing appropriate credit to Calnite.
Non-commercial / Personal Use
The artwork cannot be used for streaming on any platform, but may be used as profile pictures and banners or posted on social media with credit. The artwork is not intended for or directed towards, commercial advantage or monetary compensation.
Semi-commercial
The artwork can be used for streaming on any platform, as profile pictures and banners, posting on social media with credit, Non-commercial game projects for Jams. The artwork is not intended for or directed towards, commercial advantage or monetary compensation.
Full-commercial
The artwork can be used for merchandise, images used in games and novels, sold publications, and online or offline advertisements and commercial promotions. anything that is intended to make a profit directly with my work would be considered commercial use.
NDA
A Non-Disclosure Agreement (NDA) is a legal agreement that protects confidential information shared between parties during a project or collaboration. It helps ensure that sensitive business information, creative concepts, project details, and other proprietary materials remain confidential and are not disclosed or used for purposes outside the agreed scope of work.

Commission queue and status can be checked on Calnite's to-do list.
If you have not ordered a rushed commission, you may only ask for the wips/status of your commission once a week.
Calnite will send you wip/s during the commission process, Calnite will only continue working once they get an ok from you. Delayed feedback will result in delayed delivery accordingly.
There will be no revisions for sketch, surprise me and skeb commission, changes and revision are not available for this type of commission.
In sketch phase you can ask for these revisions: changing pose, redesign, changing compositions, pointing out things you don't like.
After the sketch you may only ask for these changes: color edits, small details edits, expression tweaks.
After approval of the sketch, major revisions such as scope change, changing pose, redesign, compositions changes will be charged.
After 3 Revisions, frequent revision requests pointing out small details each time will cost CHF 20-50 extra.
Mistakes from my side will not be charged. Mistakes by unclear instruction and reference provided will be charged.
Nitpicking Calnite's art style and small details (that are irrelevant in the final product quality) will result in additional charges starting from CHF 50.
7. Turn around time & Deadline
Commissions can vary from within a few days to 3 months. This applies to when Calnite starts your commission, not when you paid for the commission, or when you are added to the queue.
Calnite reserves the right to pause work due to (and you will be notified):
Illness
Emergencies
Burnout
Personal circumstances
Technical issues
Delivery will be delayed based on:
Late replies/feedback or payment
Frequent revisions
Change of scopes
You may ask for a deadline beforehand, Calnite will only accept it if they are confident to finish it in your given time. if Calnite accepts and can't finish them due to private reasons, you will be notified.
Rush deadline will cost 50-100% more depending on the rush.
8. Delivery
Calnite only offer digital commissions there will never be a physical delivery.
Final files will be delivered, depending on agreement, via Discord, Google Drive or E-mail.
You will receive a jpg for static images and a gif or mp4 for animation, if you want a specific file type let Calnite know beforehand.
PSD, layered, or transparent files cost 50 - 100% additionally. This exclude Vtuber Model and Sprite Art.
The commissioner is responsible for downloading and backing up files after delivery. Calnite not responsible for storing files indefinitely.
9. Refund policy
Refund will only be issued if Calnite has not started working on your commission, and you will be refunded only 50% of the paid amount.
If Calnite has started working on your commission and sent you wips, you will not receive a refund.
You will receive a full refund if Calnite cancels your commissions and have not started working on it.
Chargeback in any circumstance is a violation of Calnite's term of service.
10. Violations of these terms
If you violate these Terms I (Calnite) may, at my discretion and where appropriate:
Suspend or terminate your access to my services.
Cancel or refuse current or future commissions, orders, or collaborations.
Revoke any license granted to use our artwork, digital products, or other intellectual property.
Require the immediate removal or cessation of any unauthorized use of my work.
Resell and repurpose the current work.
Take appropriate legal action to protect my rights.
11. Changes to these terms
Calnite's term of service may be updated from time to time. The latest version will always be published on this page.
Any updates to this Term of service will be applied to all old and new commissions.
